Agil8 Limited – Public Training Terms and Conditions

1. Bookings/Registrations

Public training course bookings can be made in the following ways;

  • By telephone: +44 207 796 9903

When registering via our website, payment can be made immediately by Credit/Debit Card, or select invoice option for BACS/PO/Wire Transfer payments.

It is the responsibility of the booker to provide agil8 with a Purchase Order if one is required, and to ensure agil8 has been provided with current company accounts payable details including email address. Please email POs to finance@agil8.com and we can re-issue the invoice quoting the PO number.

Making a booking constitutes a binding contract according to our terms and conditions herein.

2. Payment

Invoices are payable in full within one month of registration/invoice date, or more than 14 days prior to the course start date (whichever is sooner). Agil8 financial information and terms of payment are included on our invoices, however should you require further information please email finance@agil8.com.

Payment can be made directly via our website at the time of booking by Credit/Debit card including Visa, Mastercard and American Express.

3. Late Payment

Agil8 reserves the right to refuse course admission if payment has not been received prior to the course start date.

Under the Late Payment of Commercial Debts (Interest) Act 1998, late payment will be subject to an interest charge of 8% above base rate on the full amount outstanding.

4. Customer Cancellation/Transfer

4.1 No-Show Policy

Where agil8 receives no cancellation notice from the customer prior to the start of the course, and the delegate does not attend the training, the following will apply:

  • No refund of the course fee will be made. If payment has not been made, full payment plus any applicable interest charge will be due immediately.
  • The option to transfer is not available and a new course booking will need to be made and paid for.

4.2 Substitution Policy

A substitute can be named up to 2 days prior to the course at no extra charge, except for the Agile Project Management courses where at least 5 days’ notice is required and a 5% charge will be applied to cover the cost of re-sending course materials. Please also note that for the latter, substitute delegates must have the necessary pre-requisites in order to attend the course. Please check our website for more details.

4.3 Transfer Policy

Agil8 understands that circumstances may occur which require the customer to re-schedule training to another agil8 public training course. All transfers must be confirmed by email and the following fees will apply immediately.

4.4 Cancellation Policy

All cancellations must be confirmed by email and the following fees will apply immediately.

5. Cancellation and alterations to course contents, dates, venue and trainer

Agil8 reserves the right to cancel or change any public or in-house course and undertakes to provide reasonable notice of the cancellation or change except in the case of an emergency. The delegate will be entitled to a refund of fees paid to agil8 in the event of a cancellation or any change to the course date or significant change in venue, but shall not otherwise be entitled to compensation or costs or damages arising from such a cancellation or change. We will do our best to accommodate delegates on to a suitable alternative course/date.

6. Refunds

Agil8 will refund fees paid according to Section 4. If payment for the order was originally made by credit card, any refund due will be made back to the same card. If payment for the order was made by another method, the refund will be made by direct bank transfer.

7. Fees, VAT, Card Charges and Receipts

All agil8 public courses are subject to VAT at the current rate. Public course fees include tuition on the day(s), all relevant course materials, and lunch and refreshments. Exam fees, certification and membership fees are included for relevant courses.

Agil8 is responsible for covering any credit card charges arising from use of the online registration system. However, in the event of a cancellation, these fees may be passed on to the Customer.

For non-UK delegates attending our UK courses the following applies regarding VAT;
Our invoices are chargeable to UK VAT at the 20% standard rate on the basis that place of supply for VAT purposes is where the admission to the training event takes place. We understand that the UK VAT chargeable can be claimed under the EU VAT refund procedure.

8. Course Joining Instructions

Course Joining Instructions include venue details, course start/finish times and trainer details. These are sent within 24 hours of registration. These are system-generated CJIs and may occasionally be blocked by email providers. Please check your junk mail folder, and if you have not received CJIs please contact us by calling or emailing us. 9. Copyright

All agil8 course materials including graphics, code, text products, software, audio, music and design is owned by agil8 Limited or agil8 third party course providers. No content, in whole or in part, of the agil8 materials may be copied, reproduced, uploaded, posted, displayed, linked to, or used in any way without the prior written permission of agil8. Any such use is strictly prohibited and will constitute an infringement of the copyright and other intellectual property rights of agil8, or in the case of material licensed to agil8, the owner of the materials.

10. Non-EU Delegates

Agil8 welcomes customers from overseas, but for those resident outside of the European Union, a valid visa, and the ability to comply with all immigration requirements should be in place prior to making a course booking.

Please note that agil8 training and events do not qualify customers for a student visa or for entry to the UK or other EU countries. Visa information is given here; https://www.gov.uk/government/organisations/uk-visas-and-immigration

Customers wishing to apply for entry to the UK should contact the nearest British Mission that offers a visa service. A full list of UK Overseas Missions is provided on www.fco.gov.uk.

Agil8 cannot process course bookings from outside the EU without full payment in advance. Once payment has been made, cancellation fees are payable in accordance with terms and conditions outlined in this document.

Travel costs or other expenses incurred are entirely the responsibility of the customer.

11. Discounts

Early Bird – Agil8 offers a discount for customers registering and paying at least 4 weeks prior to the course start date. Please see website for current prices. Discounts and Special Offers are at the discretion of Agil8 and can be withdrawn at any time.

Previous Student Discount – Agil8 offers previous Agil8 students a discount of up to 20% off selected future courses booked by the same student. Please enquire for details.

12. Force Majeure

In no event shall Agil8 Limited be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes, inclement weather and communications or computer (software and hardware) services, it being understood that Agil8 Limited shall use reasonable best efforts which are consistent with accepted practices as a training provider to resume performance as soon as practicable under the circumstances.
